Rental guarantee

As a lessor, you can ask your tenant to pay a rental guarantee. This is a financial guarantee deposited by the tenant and kept by the owner until the end of the rental agreement. It is not mandatory, but it must be mentioned in the lease. The lessor can use the amount to reimburse any damage or problems caused by their tenant.   
  • My rental guarantee at the FPS Finance

    Through its application e-DEPO, the Deposit and Consignment Office of the FPS Finance allows you to store and manage various amounts, including your rental guarantee. This service protects both the lessor and the tenant during and after the rental period. By placing your guarantee with the Deposit and Consignment Office, you will benefit from a digital administration system that is secure and GDPR compliant. The amount is blocked and can only be used in case of damage, with the consent of both parties, ensuring enhanced protection for the tenant. Under no circumstances can the lessor unilaterally claim the guarantee. 
  • About e-DEPO

    Through e-DEPO, all citizens and private institutions can enter and manage various consignments, such as guarantees, at the Deposit and Consignment Office. 

    Managing guarantees through e-DEPO has a number of advantages for its users: 

    • Simple and secure deposit/refund 
    • Interest rate on funds deposited for at least one year 
    • Secure permanent access guaranteed by means of a digital key (e.g. electronic identity card or Itsme) 

    For reasons of security, speed and compliance with data protection rules (GDPR), all types of guarantees, deposits and consignments that can be dealt with via e-DEPO, should mandatorily be sent through this application. 

  • Lessor

    Are you a lessor? In this section, you will find all information about the rental guarantee. In order to release or apply to a rental guarantee, you should to take the following steps: 

    1. Go to e-DEPO 
    2. Sign in with your identity card or through Itsme 
    3. Click on the required file 
    4. Under 'Available actions', select: 
      1. Release, if you wish to release the rental guarantee 
      2. Deduction in advance, if you wish to receive the rental guarantee, or part of it 
    5. Fill in all empty fields with the correct data 
    6. Click approve and check the details 
    7. Click create 

    Your request has been registered. You will receive an e-mail at the e-mail address you provided. The tenant needs to validate the deduction in advance in e-DEPO. A release is made automatically. You will receive an e-mail at the e-mail address you provided.  

    How do I connect to e-DEPO as a non-Belgian citizen? 

    You do not have a Belgian authentication method (eID, Itsme, token) or eIDAS? You can access our application through the application ForREG (Foreign Registration).

    • I want to consult my file.

      1. Go to e-DEPO.  
      2. Sign in with your identity card or through Itsme 
      3. Choose your identification mode 
        1. Personal name 
        2. Company name 
      4. Click on 'Consultation of my files' or enter your file number 
      5. Click on the file to open it 
      6. Find the available actions at the top 
    • My file does not appear.

      There are two possible reasons why your file does not appear. 

      1. You do not have proper access to the file. 
      2. Your file has not yet been transferred from the old application to e-DEPO. 

      Contact info.cdcdck@minfin.fed.be and mention: 

      • Your (old) file number   
      • The national (register) number of any natural person involved in the file.  
      • The Belgian company number of any professional, company or public body involved in the file.  
      • The e-mail address of all above-mentioned parties 

      The FPS Finance will transfer your file to the e-DEPO application. You will receive an e-mail at your e-mail address when your file is available in e-DEPO. 

    • There are no more available actions in my file.

      A file is usually blocked after the tenant has refused the deduction in advance, or due to attachment or a conflict between parties.   

      To unblock a file, you should submit a request to the Deposit and Consignment Office via info.cdcdck@minfin.fed.be. The documents required depend on the reason for the blocking:  

      • In case of refusal of the deduction in advance or conflict: Await a judgement or agreement between the parties. 
      • In case of attachment: Await the outcome of the attachment proceedings.  
    • I want to receive my guarantee deed.

      After creating the file, the tenant has 30 days to pay. It may take a few days before the payment is visible in e-DEPO. You will receive an e-mail once the payment is received and your e-mail address is in the file. e-DEPO will then create the guarantee deed, which you can view and download online.  

    • I want to change parties in my file.

      For example, if the situation of the tenant changes to a co-housing situation but the guarantee remains the same, you will need to make an addendum to be added to the rental agreement. You should note which legal changes (articles) have been made. Send the following documents to info.cdcdck@minfin.fed.be to update your file:  

      • The addendum, signed by all parties,  
      • A copy of the original rental agreement,  
      • A copy of the identity cards of all parties,  
      • Your file number in e-DEPO.  

      In case of the death of a party, it is not possible to deal with the file yourself in e-DEPO. The party entitled to the amount should contact the FPS Finance via info.cdcdck@minfin.fed.be. Attach the necessary supporting documents to your e-mail: 

      • Copy of proof of identity 
      • Certificate or deed of inheritance 
      • Proxies 
      • Judgement 
      • Proof of appointment 
      • etc. 

      An employee of the FPS Finance will then deal with your request. You will receive an e-mail at your e-mail address confirming this update. 

    • I am not the only lessor.

      Your co-lessors should also agree before the amount is released. 

      Giving my agreement: 

      1. Go to  e-DEPO 
      2. Select the appropriate file 
      3. At ‘Available actions’ select: 
        1. Consult a request 
      4. Validate or reject the request 
  • Tenant

    Are you a tenant? In this section, you will find all information about the rental guarantee. In order to deposit your rental guarantee: 

    1. Go to e-DEPO 
    2. Sign in with your identity card or through Itsme 
    3. Choose the category 'rental guarantee' 
    4. Click on 'create a new file' at the bottom right  
    5. Fill in all empty fields with the correct data 
    6. Receive payment instructions in the last field  
    7. Deposit the amount within 30 days 

    The amount and communication should be correct. If not, your payment will be automatically refunded. 

    If you have provided your e-mail address, you will receive the payment confirmation in your mailbox.

    • I paid my rental guarantee too late.

      If e-DEPO does not receive payment within 30 days, the file will be automatically cancelled. For a new payment, you should complete the steps again to create a new rental guarantee file. The (late) payment will be automatically refunded in this case.
